Our office does a significant number of expunctions each year in which a criminal charge or charges in Guilford County are removed from a client's criminal record. There are several types of expunctions available under North Carolina law including expunctions for charges that were dismissed or for which the defendant was found not guilty, expunctions for certain drug charges following a 90-96 probation, and expunctions for a misdemeanor committed prior to the defendant's 18th birthday for which he is found guilty followed by a period of time with no further criminal convictions. There is also an expunction for identity theft.
North Carolina law offers this once in a lifetime opportunity to clean up a criminal record for school, employment or military purposes. It is a lengthy process that may require up to 4 months for completion.

In recent years, the North Carolina legislature has contemplated some attempts to make it easier to get an expunction. To date, this has not been done; but we will continue to monitor these efforts so that we can provide accurate information as to what is available for our clients.
